Pasil ordinance on pricing of private land expropriated for public use gets Kalinga SP approval

Pasil, Kalinga – To pave the way for more developments in Pasil, private property owners will soon have to strictly comply with the assessed compensation of their properties once the government will take them for public use in Pasil.


This is after the Municipal Ordinance No. 2021 – 05 entitled, “Adopting the Schedule of Recommended Zonal Values of Real Properties in the Assessor’ss Office as Basis for Just Compensation of Expropriated Properties in Pasil, Kalinga” was upheld by the Sangguniang Panlalawigan members this June 22.


The ordinance form the basis in determining just compensation of properties involved in eminent domain proceedings in Pasil. The ordinance stipulates that it will use the existing or approved zonal value issued by the Municipal Assessor’s Office as the final prevailing rate.

Meanwhile, Councilor Ronnie Bawalan said he proposed and authored the ordinance in the hope that it will solve problems with some private property owners who want their property to be paid beyond its assessed value.

Content of the Ordinance


Under the ordinance, there will be an expropriation team or the ones who will negotiate with private property owners to give up their properties to the government for public use with just compensation.

The expropriation team shall be composed of the Municipal Assessor as the Chairman with the Sangguniang Bayan Chairperson on Public Works and Utilities, Facilities, Infrastructure and Special Projects, the Municipal Engineering Office, and the Pasil Municipal police chief as members.


This team will negotiate and convince private individuals to sell their property using the existing or approved zonal value as the final prevailing rate.

Moreover, with the ordinance, all individuals intruding within public lands shall pay P2,500 in the municipality apart from penalties under the national law.
