Tabuk City, Kalinga – Members of the Sangguniang Panlungsod during their session this November 9, agreed to seek legal opinion from the Department of Interior and Local Government and Department of Budget and Management to establish the legality of fund transfer to the barangay from the CLGU for the purpose of purchasing a piece of land.
One among the agenda during the said session is the letter of City Vice Mayor Bernard Glenn Dao-as stating his observation on the request of City Mayor Darwin Estrañero to be granted authority to approve fund transfer from the CLGU to the BLGU for the purchase of lot.
“Siyempre macurious ak lang ah ta apay nga matransfer met amin ti fund iti barangay,” said Dao-as.
Dao-as in his letter said he wanted to make clear that he is not against the fund transfer but he wants to know the reasons behind it.
Dao-as asked two questions if the City LGU transfers its fund to the barangay for the buying of lot: 1) Who will appraise the lot to be purchased by the barangay, and 2) If it is the City Inventory Assets and Management Appraisal Committee or tha City Bids and Awards Committee, who will be responsible for the appraisal of the property to be purchased including its procurement process, and thus what is the essence of tranferring the fund to the barangay for lot purchase?
Councilor Dick Bal-o first recommended to refer the matter to the Committees on Finance and Rules and made a motion that the Sanggunian is to create a resolution to be addressed to DILG and DBM, asking for their legal opinion on the transfer of fund to the barangay for the purchase of lot.
This was seconded by Councilor Zorayda Wacnang, “it should be referred to the Committee on Finance since it involves the transfer of funds and on the Committee on rules pero I agree with the recommendation of Atty. Bal-o that since there is a question on whether it is on ...(inaudible) we might as well get the legal opinion of DILG and DBM,” she said.
Meanwhile, Councilor Ivan Yannick Bagayao commented that they should seek first the opinion and statement of the Legal Office and the Budget as to not bypass them and also, they might have a documentary explanation ready for the matter.
“Eventually nu haan tayo nga satisfied ditoy mapan tayo metlang ijay DILG province wennu region as well as DBM,” Bagayao added.
Nevertheless, the body agreed to do both, make a resolution to get the opinion of DILG and DBM as to the legality of fund transfer to the barangay for the purchase of lot as well as to get the opinion and explanation of the City Budget and City Legal Office for the matter.
“Awan met problema basta importante legal,” Dao-as stressed.
